Benefits students choosing to study in Australia This is great news for students and means you will be able to complete your Australian qualification in 16 months and will save money.
Prior to 1 September 2005 you had to study for two years while living in Australia in order to be eligible to claim the work experience waiver.
Now, provided you
- Study a CRICOS registered full-time course at an Australian educational institution entirely in the medium of English
- Complete four semesters of equal length over 16 months at least. Ensure your study load is a full study load (usually three subjects but check with your course provider)
- If you choose to study in a Summer semester, ensure this semester is of exactly the same duration as all other semesters offered by the educational institution. Check with the Registrar's Office
- Lodge a permanent residence application (or other application for which you are eligible) within six months of completing course requirements, you will be eligible to apply for permanent residence provided you can meet all criteria for grant of the visa for which you are applying
You will of course need to satisfy all other criteria relevant to the visa application you are lodging, including health and character requirements.
From 8 th October 2005 migration regulations will allow for exceptional circumstances beyond a student’s control be considered prior to canceling a student visa for a breach of condition 8202. This means that students will be given the opportunity to provide an explanation and evidence for consideration prior to a decision being taken to cancel their visa.Under Condition 8202:
- You must remain enrolled in a full-time CRICOS registered course (unless you are an AusAID/Defence or secondary school student who holds a subclass 560 visa, in which case you must be enrolled in a full-time course of study or training)
- You must attend at least 80% of the contact hours scheduled for each term or semester of your course
- You must have a satisfactory academic result for each semester
- From 1st May 2006 it will no longer be necessary to wait three month after sitting an IELTS test to re-sit another test. This will be extremely helpful to students who want to lodge a permanent residence application and need to provide a recent IELTS result. If they do not achieve the score they require, they can re-sit the test to suit their own time constraints
